  Tim Dwyer is a Liar.
  We signed a 12 month lease however, we vacated property after 41 day. The land lord and the managing agent Tim Dwyer, from Tim Dwyer Real Estate, refused to clean up the Asbestos contamination in the back yard.
  
  Despite 14 emails and dozens of phone calls to Tim Dwyer, no action was taken to decontaminate the back yard. Each time we found a piece of Asbestos the land lord would send a contactor to collect it. Despite being the managing agent, Tim Dwyer refused to write to the landlord to outline their obligations. In Tim Dwyer’s words “I am just here to collect the rent”…“Any issues you have with the rental property is between you and the land lord”.
  
  After finding dozens of pieces, Tim Dwyer agreed to pay for a professional Asbestos contamination inspection. The Asbestos inspector found numerous pieces of Asbestos in the back yard including one piece that was 300mm X 100mm.
  
  Despite all the evidence of Asbestos contamination, including the professional Asbestos Contamination Report, Tim Dwyer turned up to the property denied any knowledge of Asbestos contamination. Tim Dwyer looked me in the eye and said “I DON”T KNOW ANTHING ABOUT ASBESTOS CONTAMINATION”. Given the first line of the REIV member charter is, “be ethical, honest and fair to all”, I don’t know how the REIV allows Tim Dwyer to remain a member.
  
  To make matters worse, Tim Dwyer refused to pay for the Asbestos Contamination Inspection Report despite his office explicitly, in writing, authorising us to engage an Asbestos inspector. The land lord also refused to pay for the Asbestos contamination report as Tim Dwyer had (apparently) not discussed it with him.
  
  At this stage we were trapped in a rental property contaminated with Asbestos and stuck with $800.00 invoice for an Asbestos Contamination Report? Despite Tim Dwyer’s office reviewing the Asbestos inspector’s quote and authorising us, in writing, to engage the inspector, Tim Dwyer though it was perfectly OK not to respond to phone calls or emails regarding payment. Consequently, I paid for the Asbestos Contamination Report as Tim Dwyer remained silent.
  
  Despite the land lord and Tim Dwyer holding the professional Asbestos Contamination Report for 14 days, neither party provided any written response to the report. To make matters worse, Tim Dwyer decided he was no longer the managing agent and then absolved himself of discussing anything further. Put quite simply, Tim Dwyer authorised us to engage an Asbestos Inspector then refused to confirm or deny doing it.
  
  A couple of weeks later we lodged a VCAT application against the land lord and Tim Dwyer. During VCAT hearing Tim Dwyer told me (privately) that landlord had been dishonest in claiming that he was remediating the Asbestos contamination. At this stage, Tim Dwyer appeared to remember the property was contaminated with Asbestos despite denying it a couple of weeks earlier. However, as soon as the VCAT hearing was over, Tim Dwyer was again the estate agent managing the rental property. Tim Dwyer obviously believes acting on behalf of a “dishonest” landlord is OK.
  
  We attended a VCAT hearing and settled for a sum of $2500.00 which covered our moving costs, the Asbestos Contamination Report and rent paid in advance.
  
  I am happy to provide copies of emails to Tim Dwyer, the VCAT application, the VCAT settlement documentation.
  
  The way my family have been treated by Tim Dwyer is an utter disgrace. Never deal with Tim Dwyer he is a shameful unscrupulous liar.
